1. Introduction

Welcome to Bananium. These Terms & Conditions govern your access to and use of the Bananium platform, including the website, game, and associated services. By accessing or using our platform, you agree to be bound by these terms.

2. Acceptance of Terms

By accessing and using the Bananium platform, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not access or use our platform.

3. Definitions

In these terms, the following definitions apply:

"Platform" refers to the Bananium website, game, and associated services.
"NFT" refers to non-fungible tokens that represent digital assets on a blockchain.
"Digital Assets" refers to in-game items, characters, or other virtual goods that may be represented as NFTs.
"Blockchain" refers to the distributed ledger technology used to record transactions.
"Wallet" refers to digital wallets that store cryptographic keys used to interact with blockchain networks.
"AI Agents" refers to the artificial intelligence characters that users can own, train, and use in the game.
"Smart Contract" refers to self-executing contracts with the terms directly written into code on a blockchain.

4. User Eligibility

You must be at least 18 years old to access and use the platform. By using the platform, you represent and warrant that you are at least 18 years of age. If you are accessing the platform on behalf of a legal entity, you represent and warrant that you have the authority to bind that entity to these terms.

5. Account Registration

To use certain features of the platform, you may need to connect a blockchain wallet. You are responsible for maintaining the security of your wallet and any connected accounts. You agree to:

Provide accurate and complete information when connecting your wallet
Maintain the security of your wallet's private keys and seed phrases
Promptly notify us of any unauthorized access to your account or other security breaches
Take responsibility for all activities that occur under your account

6. Game Rules

Bananium Maximus is an AI battle royale game mode where players deploy their unique character to compete in exciting combat scenarios. The following rules apply:

Players must own at least one NFT to participate in tournaments
Tournament participation does not require an entry fee, each character grants one entry
Prize distributions are governed by smart contracts and determined by tournament performance
We reserve the right to modify game rules, mechanics, and reward structures
Players must not use bots, scripts, or other automated means to gain unfair advantages
Any form of cheating, exploiting, or manipulating game mechanics is prohibited

7. Digital Assets and NFTs

Bananium incorporates blockchain technology and NFTs. The following terms apply to digital assets:

Ownership of an NFT is recorded on the blockchain and represents certain rights to a digital asset
When you purchase an NFT, you own the NFT itself, but not necessarily the underlying intellectual property
We grant you a limited, non-exclusive, non-transferable license to use the digital assets associated with your NFTs within the platform
Digital asset appearance and utility may change over time as the game evolves
We do not guarantee the value, rarity, or utility of any digital asset
Blockchain transactions are irreversible; we cannot recover lost assets due to user error

8. Fees and Payments

Certain features of the platform may require payment of fees. You acknowledge that:

All purchases are final and non-refundable
Transactions on the blockchain incur network fees (gas fees) that are not controlled by us
Prices of digital assets are subject to change without notice
You are responsible for all taxes associated with your transactions
Payment methods and currencies accepted may change over time

9. Intellectual Property

All content on the platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Bananium or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the platform for its intended purposes. You may not:

Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the platform
Use the platform or its content for any commercial purpose without our prior written consent
Decompile, reverse engineer, disassemble, or otherwise attempt to derive source code from the platform
Remove any copyright, trademark, or other proprietary notices from the platform or its content

10. User Conduct

When using the platform, you agree not to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Use the platform to transmit any harmful code or malware
Attempt to gain unauthorized access to any part of the platform
Interfere with or disrupt the platform or servers connected to it
Use automated scripts or bots to access or interact with the platform
Engage in any behavior that could harm other users or the platform itself

11. Risk Disclosure

You understand and acknowledge that:

Blockchain technology and cryptocurrencies involve significant risks
The value of digital assets can fluctuate dramatically
Regulatory changes may affect the platform's operations and the value of digital assets
Smart contracts may contain bugs or vulnerabilities
Your ability to access your digital assets depends on factors outside our control, such as the availability of blockchain networks and your own wallet security
The platform may experience technical issues, including service interruptions and security breaches

12. Limitation of Liability

To the maximum extent permitted by law, Bananium and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with these terms or your use of the platform.

To the maximum extent permitted by law, we shall not be liable for any claims relating to these terms or the platform.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bananium and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms or any activity related to your account.

14. Modifications to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new terms on the platform. Your continued use of the platform after such changes constitutes your acceptance of the modified terms.

15. Termination

We may terminate or suspend your access to the platform immediately, without prior notice or liability, for any reason, including breach of these terms. Upon termination, your right to use the platform will immediately cease.

16. Governing Law

These terms shall be governed by and construed in accordance with the laws of the country from which you access the platform, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that country.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the terms will otherwise remain in full force and effect and enforceable.
